By using Chatbot you confirm that you accept these terms of use and you agree to comply with them. & please read these terms and conditions carefully before using Chatbot. We are offering you Chatbot for your personal use without cost, but you should be aware that you are not allowed to copy, or modify it, any part thereof, or our trademarks in any way. You are not allowed to attempt to extract the source code of Chatbot, and you should also not try to make derivative versions.

Chatbot has been developed and is operated and maintained by or on behalf of Access Bank Plc ("Access", "Access Bank" "we" "our" or "us"). Chatbot, and all the trademarks, copyright, database rights and other intellectual property rights related to it, belongs to Access Bank Plc or our licensors.

Preamble

The Chatbot is a service we offer that enables you to receive information from us and to transmit instructions to us electronically, in relation to your account domiciled with us (“an Account”) or other matter(s) we specify, through a mobile Application, URL and other channels.

Each time you use Chatbot theseTerms of Use apply.

Access to Mobile Banking

Not all devices are capable of accessing and supporting Chatbot. It is your responsibility to ensure any device you use to access Chatbot is compatible and capable of supporting Chatbot. We will not be responsible for any damage or loss to a device as a result of your access or use or attempted access or use of Chatbot.

The features of Chatbot include but are not limited to:

  • Funds Transfer (between own accounts, to other Access Accounts and to other banks {NIBSS Instant Payment})
  • Bills payments (DStv, LCC, PHCN etc.)
  • Stock prices, purchase and sale
  • Bank enquiries
  • Airtime Purchase
  • Loan

Your Account number, phone number, PIN, registration code, One Time Password (OTP) and Hardware/Software Token ("Login Details") may be required to successfully carry out some financial and self-service transactions on Chatbot.

Under no circumstances shall you allow anybody access to your Account through the service by divulging your transaction pin to a third party (intentionally or negligently), as you shall be solely liable for such disclosure and any consequences arising thereto.

You understand that your Sign-up Details are used to give instructions to us and accordingly, you undertake that:

  • Access Bank is irrevocably authorized to comply with any instruction given to it through Chatbot and it is agreed that such instruction shall be irrevocably deemed to be your instruction.
  • You hereby agree to change your Login Details or any other log in parameters immediately you are aware or suspect that it has become known to someone else.
  • Access Bank is exempted from any form of liability whatsoever for complying with any or all instruction(s) given by means of your Login Details or any login parameters and accordingly, we shall not be responsible for any fraudulent, duplicate or erroneous instructions given by means of your Login Details or parameters.
  • Access Bank is expressly exempted from any liability arising from unauthorized access to your Account and/or data as contained in our records, which arises as a result of your inability and/or otherwise to safeguard your Login Details or any other login parameters and/or failure to log out of the system completely by allowing on screen display of your account information.
  • Access Bank is further relieved of any liability as regards breach of duty of secrecy arising out of your inability to observe and maintain the secrecy of your Login Details or login parameters as the usage of these details by any third party shall be deemed to be with your consent.
  • Access Bank is further relieved of any liability for loss that may arise as a result of transfer of ownership of the device on which Chatbot rests either by theft, gift or by any other means.
  • Access Bank is further relieved of any liability for loss that may arise as a result of acts of hackers, viruses, malware etc and other unauthorized access to your account via Chatbot.
  • Access Bank is further relieved of any liability for loss that may arise as a result of transfer of ownership of the phone number which you have registered with the Bank on which the registration code is received.
  • You hereby agree to urgently notify Access Bank immediately upon your suspicion that the confidentiality of your Login Details are compromised.
  • You hereby irrevocably accept responsibility and shall bear liability for any fraud, loss and/or liability to Access Bank or third party arising from usage of your Login Details on this Chatbot.
  • Access Bank may terminate this service without notice to you when at its discretion it determines that you have used Chatbot in a way that is contrary to these.
  • Access Bank will NEVER send you a link to any external website or request for your personal banking details or log in credentials via SMS, e-mail, telephone or any other means. Kindly disregard such SMS, emails and phone calls.
  • Access Bank may vary the terms of this ToU at any time without notice to you and you agree to waive the requirement of notice.
  • You recognize and acknowledge that Access Bank shall be providing Chatbot on an "as is" basis and does not warrant to its reliability. Access to Chatbot may from time to time be unavailable, delayed, limited or slow due to, but not restricted to hardware failure, software failure, overload of system capacities or other force majeure.
  • Access Bank does not guarantee that Chatbot or any content on it will be available or be uninterrupted. We may suspend or withdraw or restrict the availability of Chatbot or any of its features for business and operational reasons without prior notice to you.
  • Access Bank may at any time, suspend or cancel your right to use Chatbot entirely or in respect to specific facilities, or refuse to reset, renew your usage without affecting any outstanding obligation you may have under this agreement.
  • Access Bank has the right to disable any user identification code or password whether chosen by you or allocated by it at any time if in our reasonable opinion you have failed to comply with any provisions of these terms of use.
  • Access Bank has the right to close your account and or withhold any funds in it as a result of any fraud which may be linked to you in connection with the use of Chatbot.

Availability and Registration

By accessing or using Chatbot, You hereby warrant that:

  • You have the legal capacity and authority to bind yourself to these terms and conditions, and
  • You will be deemed to have read, understood and accepted these terms and conditions (ToU) when you log in to Chatbot, and agree to be bound by this ToU.

If you do not agree to any part or all of the ToU, or do not represent the foregoing, you may not access or use Chatbot.

You will not be able to use Chatbot until you have registered to use the service. We can refuse to register you for the service and refuse to allow you to use and/or restrict your use of Chatbot at any time.

Applicable Terms
We reserve the right to modify this ToU as required. If the ToU is modified, we will post a clear, easily accessible modification notice on Chatbot. If you continue using Chatbot, you will be bound by any or all modifications made to it.

Transactions between:

  • All transactions from N1.00 to N100,000.00 will be authenticated using your PIN set up at registration and OTP.
  • N20,001.00 and N200,000.00 will be authenticated using PIN set up at registration and OTP.

You agree to pay our charges for transactions which you initiate. Should these charges not be acceptable to you, please do not consummate the transaction as your conclusion of the transaction will be deemed as your consent to the charges. We reserve the right to review our charges at any time without prior notice to you. Any such revised charge(s) shall be indicated on this ToU.

In addition to our charges, you may be charged by your service provider for accessing Chatbot on your mobile phone, computer, tablet or other handheld device (the Device). These may include data roaming charges if you do this outside your home territory. All of these charges are solely your responsibility.

Furthermore, you consent and acknowledge that the information provided in other to effect an online money transfer of bill payment is true, accurate, current and complete. You are obligated to confirm that the information is accurate as we will not be liable for any liability for concluding a transaction with details you supply.

Minimum System Requirements

Chatbot will only work on compatible Devices and operating systems and certain functionality will only work if your Device is connected to the internet. Some features may also only be available with certain operating systems.

Use of Your Personal Information

Your personal information is processed under applicable law. Details of the information we collect and how we use it, including where this is shared with third parties is as set out in the privacy policy below.

Through your use of Chatbot, we also collect, store and use your username, language selection, country selection and location data and our use of this personal information is subject to your opt-in choice and the applicable provisions in the privacy policy.

Certain functionality of Chatbot may need to access your Device and information stored on it so that it works properly. By using Chatbot you consent to this.

Your Use of the Chatbot

You must comply with these terms of use as these apply to your use of Chatbot, as well as such other applicable terms of use in respect of such services as you may access and use through Chatbot. Any violation of these ToU may result in the termination of your access to Chatbot.

You may only use Chatbot for your personal use and not in connection with any commercial endeavours. You must not copy or modify any part of it in any way.

You must not attempt to extract any source code from Chatbot, disassemble or reverse engineer it, or make any derivative versions, or attempt to interrupt or decipher the transmissions between Chatbot and our systems.

You must not use Chatbot for any of the following purposes:

  • anything unlawful or illegal or which is fraudulent or malicious or which promotes any criminal activity or provides information about the same;
  • anything which is defamatory, harassing or threatening or which otherwise infringes or violates the rights of others. This includes any information that you may add or upload to Chatbot;
  • interfere in any way with any other users of Chatbot; and/or
  • knowingly introduce viruses or other malicious or harmful material or use it in connection with unsolicited communications.

Access Bank will report any such breach of use to the relevant enforcement authorities and will co-operate with those authorities by disclosing your identity to them. We also have the right to disclose your identity to any third party who is claiming that any act of yours or content introduced by you to Chatbot constitutes fraud, a violation of their rights to privacy or any other rights. You must not use Chatbot in a way that may damage or impair Chatbot and its service or our underlying systems and security.

Security is of paramount importance. You must keep your device secure and properly close Chatbot after each use. You must ensure that any security details account information and all other information that you provide to us via Chatbot or otherwise is complete, accurate and up to date.

Intellectual Property Rights

Chatbot and all copyright, database rights, trade marks and other intellectual property rights related to it belong toAccess Bank Plc or our licensors.

Our Responsilibities to You

While we will endeavour to ensure that Chatbot is normally available 24 hours a day, we shall not be liable if for any reason Chatbot is not available at any time or for any period. Access to Chatbot may be suspended temporarily from time to time and without notice in the case of system failure, maintenance or repair or for any reason beyond our control or if we deem it necessary. For the avoidance of doubt, we shall not be liable for any loss or liability which may be suffered or incurred by you as a result of any suspension of, or interruption to, the operation of Chatbot.

Chatbot, including all content on or services available through Chatbot, is provided on an “as is basis” and we do not make any representation or give any warranty in respect of Chatbot or any of its content or features.  In particular, but without limitation, we do not give any warranty as to the accuracy, suitability, reliability, completeness, performance, fitness, freedom from viruses or timeliness of the content or features contained on Chatbot.  The content of Chatbot is not intended as advice and should not be relied upon. We exclude all implied conditions, warranties, representations or other terms that may apply to Chatbot or any content or material on it.

We do not accept any responsibility to you for:

  • malfunctions in communications facilities which cannot reasonably be considered to be under our control and that may affect the material you access via Chatbot;
  • any losses or delays in transmission of messages or material you access arising out of the use of any Internet access service provider or mobile network service provider or caused by any browser or other software which is not under our control;
  • viruses that may infect your computer equipment or other property on account of your access to or use of Chatbot or your accessing any materials on Chatbot;
  • any unauthorised use or interception of any message or information before it reaches Chatbot or our servers from Chatbot;
  • any unauthorised use of or access to data relating to you or your transactions which is held by us (unless such use or access is caused by our negligence, fraud or failure to comply with laws relating to the protection of your data), to the extent permitted by local law;
  • any content provided by third parties.

Limitations of Liability

We and our group companies and their officers, directors, employees, shareholders or agents, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in any way or in connection with:

  • Chatbot and your use, delay in use or inability to use Chatbot or if it does not work as you expect or would like or if it contains any defects or errors and whether or not we correct any of those defects or errors;
  • your reliance on, access to and use of any material, content or feature on Chatbot or material linked to or referred to on Chatbot; and/or
  • any loss or damage to your Device or any other hardware or software you use in connection with Chatbot, including in connection with any viruses that may affect the same on account of your downloading and use of Chatbot.

You acknowledge that use of Chatbot is dependent on third parties, including your own network providers, and that we are not liable for any acts or omissions of those third parties.

We or any of our group companies  or their officers, directors, employees, shareholders or agents do have any liability to you for any kind of loss or damage for any reason under or in connection with these ToU.

You shall indemnify us (and you shall keep us indemnified) and hold us and our directors, employees, agents and representatives harmless against any claim, loss, expense, liability or damages suffered by us resulting from your breach of these ToU or your use of Chatbot.

Termination and Suspension
We may terminate or suspend your use of Chatbot with or without notice at any time and without any liability to you. Upon any termination your right to use Chatbot, and any other rights or permissions granted to you in these Chatbot ToU, will end and you must stop using Chatbot and delete it from your Device.

Law and Juridiction

These Chatbot ToU and any dispute or claim arising out of or in connection with them or their subject matter (including any non-contractual disputes or claims) will be governed by Nigerian laws and the parties agree that the Nigerian courts will have exclusive jurisdiction to settle any such disputes or claims.

Privacy Policy

Introduction: Chatbot has been developed and is operated and maintained by or on behalf of Access Bank Plc ("Access Bank", "we" "our", or "us").

Access Bank is committed to protecting the privacy of your personal information whilst striving to provide the very best user experience. We want Chatbot to be safe and enjoyable for everyone.

We will only use your information in accordance with your instructions and as set out in this privacy policy.

  • How We use the information that we collect By providing us with your personal information, you consent to us:
    a) processing your information as set out in this privacy policy and in any other manner you expressly consent to; and
    b) processing your sensitive personal data (if provided); if necessary for these purposes
  • Who we may share your personal information with
    1) Agents: We use third parties to perform certain functions on our behalf including fulfilling orders, sending emails, organising and managing competitions, promotions, surveys or polls, removing repetitive information from customer lists, Chatbot analysis, data storage and/or analysis and processing card payments. They will have access to your personal information if necessary to perform their function but they cannot use it or disclose it for any other purpose, unless you have specifically given them consent to do so.
    2) Aggregate Information: We may share information, such as demographics and Chatbot usage statistics, with advertisers, sponsors and other organizations.
    3) Third-Party Ad Serving Services: We or Facebook chat may use a third-party network advertiser to serve advertisements within Chatbot. Network advertisers are third parties that display advertisements based on the category Chatbot falls into. Third-party ad serving enables us to target advertisements to you for products or services you might be interested in. These advertisers and/or sponsors may themselves set and access their own cookies on your Device if you choose to have your cookies enabled in your browser.
    4) Third Party Analytics Services: We may use analytics services to anonymously collect and analyse which pages or features of Chatbot are viewed/accessed and for how long and which links are followed, so that we can provide more content which is of interest to you.
    5) Law Enforcement Agencies, Regulatory Authorities & Courts: We may share information, such as your personal information, transactions and Chatbot usage statistics with Law Enforcement Agencies, Regulatory Authorities and the Courts.
  • Maintenance and storage of information
    Your information received by us are stored on servers which are owned and maintained by or on behalf of Access Bank and its group companies or subsidiaries. We may keep your information for a reasonable period for the purposes set out in this privacy policy.
  • Security
    We will adopt appropriate security procedures to help prevent unauthorised access to your information. Neither Access nor any of its group companies shall be liable for any attempt to hack or crack or otherwise gain access to any of your information on servers owned and maintained by or on behalf of Access and its group companies.
  • Policy changes
    By using this Chatbot you agree to the terms of this privacy policy, our cookies policy and our terms of use. We may amend this privacy policy and/or our cookies policy and/or the terms of use from time to time. If we do so, an updated version will be available through a link in Chatbot. You will be bound by the new terms upon your continued use of Chatbot.
  • These Terms of Use and Privacy Policy with all other matters incorporated into same by reference embody the entire agreement and understanding between you and us and supersede and terminate all prior agreements or understanding you may have with us.
